ASIC’s Enhanced Regulatory Sandbox (ERS)

Application, scope & purpose

Australia's Enhanced Regulatory Sandbox (ERS), managed by ASIC, allows eligible businesses to test certain innovative financial services and credit activities without first obtaining a license or authorization. The purpose is to facilitate innovation in the financial sector by reducing regulatory barriers for new products and services. The scope includes a broad range of FinTech innovations, including those leveraging blockchain technology, and is increasingly relevant to the underlying infrastructure of digital economies and Virtual Worlds.

MV/VW environment

While the ERS is not a dedicated MetaVerse or Virtual World sandbox, it plays a role in fostering the financial and technological innovations that underpin such environments. Projects involving digital assets, tokenization, and new payment systems, which are integral to virtual economies, can be tested within this framework. Australia is also actively engaged in discussions and policy development regarding the regulation of AI and the MetaVerse, indicating a future-oriented approach to these emerging technologies.

Role of sandbox

The ERS provides a time-limited exemption from certain licensing and disclosure requirements, allowing businesses to test their offerings with real customers in a controlled environment. ASIC provides guidance and supervision, enabling them to monitor the innovation, assess risks, and inform future regulatory adjustments. This approach aims to strike a balance between promoting innovation and maintaining consumer protection and market integrity.
